By creating an account or using The Learning Company (the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

The Service provides adaptive test-preparation practice, tutoring, and progress insights for educational purposes. Features may change over time.

3. Eligibility & accounts

Students under 13 require verifiable parental consent, or access through a school that provides consent on the family’s behalf. You are responsible for keeping your login credentials secure and for activity under your account.

4. Acceptable use

  • Use the Service only for lawful, educational purposes.
  • Do not share credentials, attempt to access other users’ data, or disrupt the Service.
  • Do not scrape, resell, or reverse-engineer the Service or its content.

5. Your content

You retain ownership of materials you upload (such as score reports). You grant us a limited license to process them to provide the Service. See the Privacy Policy for how we handle your information.

6. Intellectual property

The Service, including its software and content, is owned by us or our licensors and protected by law. We grant you a personal, non-transferable, revocable license to use it for its intended educational purpose.

7. Disclaimers

The Service is provided “as is.” We do not guarantee any particular test score or outcome. To the fullest extent permitted by law, we disclaim implied warranties.

8. Limitation of liability

To the fullest extent permitted by law, our liability arising from your use of the Service is limited [to the amount you paid us in the prior 12 months / as counsel advises].
