Terms of Service

By creating an account or using The Learning Company (the “Service”), operated by Northside Advanced Learning Applications, Inc., you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. Subscription payments for The Learning Company are processed through Stripe.

The Service provides adaptive learning practice, AI avatar access, and progress insights for educational purposes. Features may change over time.

Practice and assignment practice automatically request browser permission for optional on-device camera checks after any required age and consent checks, unless you turn off Camera checks in practice in Account privacy settings. Diagnostics and full-length exams require a separate camera choice and browser permission. You can deny access, turn off practice checks, or continue without a camera. We do not upload images or video through this face-presence check, infer emotions or identity, or use face-presence observations to change scores or question selection. Saved observations are linked to your account and session or test attempt. See the camera privacy disclosure for details.

Students under 13 require verifiable parental consent, or access through a school that provides consent on the family’s behalf. You are responsible for keeping your login credentials secure and for activity under your account.

• Use the Service only for lawful, educational purposes.
• Do not share credentials, attempt to access other users’ data, or disrupt the Service.
• Do not scrape, resell, or reverse-engineer the Service or its content.

You retain ownership of materials you upload (such as score reports). You grant us a limited license to process them to provide the Service. See the Privacy Policy for how we handle your information.

Practice camera: When you open practice or assignment practice after completing any required age and parent or school consent checks, the Service automatically requests camera access through your browser. Practice camera checks are enabled by default on this browser, and your browser controls permission. You can deny access or turn off Camera checks in practice in Account → Privacy and your data. Turning it off stops active practice checks in this browser; turning it on applies the next time you open practice. Practice has no camera preview or controls panel and works if camera access is unavailable. The camera stops when you leave practice or hide the tab. If the setting is on, reopen practice to request camera access again. The check processes frames locally to detect whether a face is visible. We do not upload or store images through this face check, identify the person, or infer emotions from the camera. We save face-present/not-detected observations and enable/stop events with the related practice question under your account. They do not change scores or question recommendations; practice works with the camera off.

Optional practice check-in: You can tell us whether you feel ready, stuck, tired, or stressed. We save the response you choose to submit with the related practice question under your account and may offer a break or tutor guidance. These are your own reports. Asking for help with the idea or steps guides a gentler next practice question. Other check-in choices offer guidance without changing question selection. Check-ins do not change grades.

Learning-service improvement: We may use learning interactions and optional camera observations to operate, evaluate and improve this learning service, subject to the Privacy Policy and applicable parent or school permissions. Saved camera observations are account-linked, not anonymous, and follow our retention policy. We do not sell student information, use it for targeted advertising or unrelated model training, or treat camera permission as permission to record live tutoring calls.Any different data use would require updated notice, a separate review, and any permissions required by law.

The Service, including its software and content, is owned by us or our licensors and protected by law. We grant you a personal, non-transferable, revocable license to use it for its intended educational purpose.

The Service is provided “as is.” We do not guarantee any particular test score or outcome. To the fullest extent permitted by law, we disclaim implied warranties.

To the fullest extent permitted by law, our liability arising from your use of the Service is limited [to the amount you paid us in the prior 12 months / as counsel advises].

These Terms are governed by the laws of [State/Jurisdiction], excluding its conflict-of-laws rules.

We may update these Terms; we’ll revise the date above and, for material changes, provide notice.

Core provides the learning platform at $29 per month. Pro adds AI avatar access at $79 per month. Monthly subscriptions have a three-month minimum commitment and renew monthly. One-year prepaid subscriptions cost $348 for Core or $948 for Pro, charged upfront and renewed annually. Existing six-month subscriptions keep their current billing schedule. Prices are in USD; applicable taxes are shown at checkout. Private live-expert tutoring is not offered for new enrollment.

A paid subscription is required unless TLC supplies a PIN or access code or assigns access to your account. That exemption lasts while the provided access remains valid.

Cooling-off requests: New paid subscribers have seven calendar days from their first payment to request a refund, less a $9.99 processing fee, subject to the usage limits in the pricing policy. The draft eligibility limit is fewer than ten completed adaptive lessons and fewer than two proctored assessments; TLC is confirming that wording before enrollment opens.

Standard cancellation: After the three-month minimum, cancellation takes effect at the end of the current billing cycle. Access continues through the paid period, with no partial-month cash refund. Standard cancellation is unavailable during the minimum; contact support for cooling-off or hardship requests.

Annual prepaid policy: The cancellation and unused-balance credit details for one-year prepaid subscriptions are being finalized before annual enrollment opens. The legacy six-month credit policy below applies only to existing six-month subscriptions.

Legacy six-month prepaid credit: After the minimum, contact support about cancellation and credit for an unused prepaid balance. This balance is account credit, not a cash refund, and expires 18 months from cancellation. It may be used for future subscription periods or eligible Score Achievement Certificates, or transferred to a sibling’s new enrollment. It cannot be applied retroactively to an existing sibling subscription.

Pause: Request one pause of up to 90 days per twelve-month period, with no documentation required. Billing, paid features, and the minimum-commitment timer pause; learning progress is retained. Contact support to arrange the pause.

Hardship: With reasonable documentation of a qualifying hardship, TLC can cancel during the minimum. You pay only for months used, with no early termination fee. Any overpayment becomes account credit valid for 24 months; cash refunds are provided where required by applicable law.

Pro score guarantee: Students who complete at least 80% of the prescribed curriculum may request review for one free month or a partial refund at TLC’s discretion. This does not guarantee a particular score or a full refund.

Use Manage billing for available standard cancellation actions. Contact support for refund, prepaid-credit, pause, hardship, or guarantee requests. These requests require review and are not processed automatically by the checkout page. Your applicable statutory rights are not limited by this policy.
